Regulations
The rules behind the task.
Three frameworks decide what banks, landlords, municipalities and investors will need to know about their buildings in the coming years. Only verified points, with sources. Regulations change; we keep this page up to date.
Reference date September 2026
The requirement
Rental homes must have at least energy label D from 1 January 2029. Expressed as energy performance: at most 290 kWh/m² of primary fossil energy use per year. There will be no ban on letting; the requirement works through supervision and enforcement.
Adding the requirement to the Dutch Buildings Decree (Besluit bouwwerken leefomgeving) is planned for the end of 2026. The government also intends to phase out labels C and D by 2040.
Supervision and enforcement
Supervision and enforcement lie with the municipality, and municipalities get a lot of freedom in their enforcement policy. The consultation did not mention separate data or funding for municipalities; it is up to them to get the task per neighbourhood into view.
What already applies
Rent points deduction since 1 July 2024. Homes with label E, F or G get a points deduction in the rent points system (woningwaarderingsstelsel, WWS). A label step therefore already affects the maximum rent today.
Renovation passport. The renovation passport will be linked to the EP advisor’s tailored advice and registered in the national label database. The start date is not yet known.

Introduced in tranches
EPBD IV was adopted in 2024. The first Dutch tranche took effect on 29 May 2026. Further parts follow in their own tranches; the government keeps the timeline up to date.
Renovation passport and tailored advice
In the Netherlands the renovation passport is linked to the EP advisor’s tailored advice and registered in the national label database. The start date is not yet known. A home dossier that records source and certainty per field fits directly onto this.
Energiehuis: independent information
The Energiehuis is the Dutch implementation of article 18 of the directive: independent information and guidance for residents. It connects to the municipal service desks and is still being developed.
Municipal instruments for the heat transition
The Act on municipal instruments for the heat transition (Wet gemeentelijke instrumenten warmtetransitie) was passed on 10 December 2024. Most of it is expected to take effect on 1 January 2027: municipalities adopt a heat programme every five years and can designate neighbourhoods.
What this means per role
Pillar 3: ESG template 2
Under Pillar 3, banks report the collateral of mortgages by energy label and by energy use in kWh/m². The template explicitly asks for the share without a label and the share that is estimated. An estimate is allowed, as long as it is reported as an estimate.
Changes to the ESG templates under CRR3 and the Omnibus package are being prepared; their exact form is still to be decided.
EU taxonomy: existing buildings
For existing buildings the criterion is energy label A, or belonging to the 15% best-performing buildings of the national stock. The evidence per property is therefore part of the reporting.
CSRD after the Omnibus
After the Omnibus package, the CSRD reporting obligation applies to companies with more than 1,000 employees and more than €450 million in turnover. Whether a party has to report differs per organisation.
